ABOUT
TERMS AND CONDITIONS OF SERVICE
If you enter into a contract with Repair Mate Limited, trading as Repair Mate Limited, to do work for you (the "Customer"), the following terms and conditions ("General Terms and Conditions of Service") will apply to the services we perform and the replacement parts or other goods we provide. It is your responsibility to familiarise yourself with these General Terms and Conditions of Service prior to allowing our technician to commence work. By allowing our technician to commence service, you are deemed to have accepted all terms and conditions outlined herein.
LATE PAYMENT FEE
Repair Mate Limited reserves the right to charge a weekly late payment fee of NZD $45 for invoices not paid on time. This fee will be added to your outstanding balance each week until the invoice is paid in full. Late fees may only be waived if agreed upon in writing by Repair Mate Limited before they are incurred.
NON-REFUNDABLE SERVICE CHARGE
Repair Mate Limited charges a non-refundable service fee (the “Service Charge”) for all non-warranty visits to the Customer’s residence or business. The Service Charge will be quoted to you prior to our visit. This fee covers the costs incurred by us for travel and diagnostic services provided by a qualified Repair Mate Limited technician. By accepting the Service Order, you acknowledge and agree to: a) Pay the Service Charge in full, whether or not Repair Mate Limited performs the recommended repairs; and b) That the Service Charge will be included in the total cost of repairs if you agree to have us perform the recommended service or replacement. If applicable, GST (Goods and Services Tax) will be included in the quoted price.
PAYMENT TERMS AND COLLECTION COSTS
Payment is due upon completion of the services unless otherwise agreed in writing. Payment may be made by cash, cheque, or credit card. You agree to pay any costs incurred by Repair Mate Limited in collecting unpaid amounts, including but not limited to, attorney’s fees, filing fees, and any other costs associated with debt recovery. Late payments may accrue interest at a rate of 18% per annum, or the maximum allowed by law, whichever is lower.
LIMITED WARRANTY
For repairs, parts, and services provided by us, we warrant that the repairs, parts, and services will be free from defects in material and workmanship, unless otherwise noted on the invoice. The warranty period is ninety (90) days from the applicable date (i) the date you receive the part or (ii) the date of the repair or service. If you discover a defect within this period, you must notify us promptly. Repair Mate Limited’s liability is limited to either replacing any defective parts or workmanship or refunding the amount paid for the service or parts. All warranty claims are subject to inspection and approval by Repair Mate Limited.
This warranty does not cover: a) Appliances used for commercial or industrial applications; b) Cosmetic or non-functional parts, including but not limited to glass, trim, knobs, panels, racks, tanks, tubs, baskets, structural parts, doors, door liners, and shelves; c) Plumbing supply lines to any appliance, whether recommended for replacement or not by Repair Mate Limited; d) Appliances that have been moved from the location where they were originally repaired or installed by Repair Mate Limited; and e) Repairs on appliances for which parts are no longer available from the original manufacturer.
The above warranties are exclusive and in place of all other warranties, whether express or implied, including but not limited to any implied warranty of merchantability or fitness for a particular purpose. These warranties extend only to the Customer.
LIMITATION OF DAMAGES
Repair Mate Limited shall not be liable for any special, incidental, indirect, or consequential damages arising from breach of warranty, breach of contract, negligence, or any other legal theory in connection with this agreement. Repair Mate Limited's liability for damages is limited to the amount actually paid by the customer for the services or goods provided. This limitation does not apply to claims for personal injury.
ENTIRE AGREEMENT
These General Terms and Conditions of Service and any Service Orders constitute the complete agreement (“Agreement”) between Repair Mate Limited and the Customer and supersede all prior agreements or representations, whether written or oral.
GOVERNING LAW AND DISPUTE RESOLUTION
This Agreement shall be governed by the laws of New Zealand, without regard to its choice of law principles. Any disputes arising under this Agreement shall be resolved through mediation. If a resolution cannot be reached, disputes will be finally settled in a New Zealand court.
DAMAGE WAIVERS
It is the responsibility of the Customer to familiarize themselves with the waivers surrounding the services we provide. These waivers apply to our services, and our price is based on the Customer accepting these waivers. By requesting our services, you are accepting these waivers. If any part of these waivers is found to be unenforceable, the remaining waivers shall remain enforceable.
Waiver of Damages When Moving Appliance
You understand that there is an inherent risk when moving appliances, including the risk of damage to the appliance itself or surrounding areas such as flooring, cabinetry, or countertops. You acknowledge that our technician is not required to move the appliance. In exchange for their willingness to do so, you agree to hold harmless both the technician and Repair Mate Limited from any liability related to such damage.
Waiver of Damages When Working with Water
You understand that appliances connected to a building's plumbing system carry a risk of leakage and/or flooding, which could cause damage. Except in cases of gross negligence by the technician, you agree to hold harmless both the technician and Repair Mate Limited from any damages caused by such an occurrence.
Waiver of Damages from Failed Cooling Equipment
You understand that refrigeration equipment can fail unexpectedly and that repairing or servicing such equipment carries inherent risks. You agree that Repair Mate Limited is not responsible for any failures or losses that may occur, including food spoilage or loss of revenue, due to the equipment failing after service.
Waiver of Damages from Lifting Glass Cooktop
You understand that lifting a glass/ceramic cooktop to access components carries a risk of breakage. While every effort will be made to avoid damage, you acknowledge that Repair Mate Limited is not responsible for any breakage or damage that may occur during this process.

Limitation of Liability
